THE 1% UNDIVIDED INTEREST IS GRANTED BY A MOTHER AND 99% UNDIVIDED INTEREST GRANTED TO HER SIBLINGS WITH A RIGHT OF SURVIVORSHIP. THE QUITCLAIM STATED THAT ALL UNDIVIDED INTERESTS TO BE HELD AS JOINT TENANTS WITH THE RIGHT OF SURVIVORSHIP. WHEN THE MOTHER DIES, IS HER 1% UNDIVIDED INTEREST TRANSFERRED TO HER SIBILINGS WHO NOW HAVE 100% UNDIVIDED INTERESTS?
THANKS.
THANKS.
Hi DGHARRIO,
As the siblings own the property as joint tenants with right to survivorship, then they would become the owner of the property after your mother's death.
