undivided interest property

Posted on: 12th Apr, 2008 10:05 pm
there are five of us that our mother left property to(undivided interest).my sister wants to have a quit claim deed made up for me to buy her part of the property(paying her so much a month).will this be legal, and can her kids still get it if she dies?
Hi Wanda,

Welcome to the forum.

How did you all get the property? Is it that your mother left a Will? Are you all on the title of the property?

Now if you are all on then title of the property, then your sister will have to inform the other owners of the property before quitclaiming?

"can her kids still get it if she dies?"
Her kids cannot get the share of the property once she quitclaims the property to you.

Feel free to ask if you have any further questions

Best of luck,
Larry

Welcome Wanda,

Larry has rightly said that you will have to inform the lender and the other owners of the property before she quitclaims it to you.

After the quit claim has been recorded, and the property paid in full, are there any other papers that I would have to fill out and have filed, showing the property is mine?

No, I don't think you need to fill out other papers. Once the quitclaim has been notarized and recorded, the property is yours. But I hope you've given the correct description of your property in the deed. It does matter a lot.

Thanks.

Thank you so much for all of your information,it has been very helpful.Yes the description of the property was accurate, and everyone has agreed to it.Do ya'll know anything about seismic exploration? We have two water wells on this property, and we are conserned about the water being harmed in some way.Do you have any information on this?

I didn't get your question. what has seismic exploration got to do with your wells, I mean aren't you doing something to protect the water there? isn't there any covering?

seimic exploration is waves shot thro the ground to find out about gas under the ground. It can shake the ground ,and our water wells are under ground, and piped up to the surface.I thought maybe ya'll might know something,I guess i was wrong. Thank You

Hi Wanda,

I think you should contact with related professionals regarding seismic exploration.

Best of luck,
Larry
