my husband or soon to be exhusband co owns a vacation/beach house in ocracoke nc with his parents. the loan that was taken out to buy the land was co signed my my brother's parents, my husband and i, buy i think the mortgage and deed is only on my father in law and husband's name. the property now both house and land is worth about 750,000 or more. now my husband and i are getting a divorce. my husband wants me to sign a quit claim deed although i have not done it per my divorce lawyer's advice. my other question is, do i have any rights to this house?
Hi marshaalavin,
Is your name mentioned in the property deed? If not, then you won't be considered as an owner of the property and you won't have to sign any property deed in your husband's name. However, if your name is on the property deed and if you sign the quit claim deed, you will lose the ownership of the property.
