Wife ill and in debt, can she quit claim?

Posted on: 24th Feb, 2010 10:53 am
Hi, a few years ago my wife was diagnosed with schizophrenia/paranoid behavior. She no longer works and receives SSDI. The other day, she said she wanted to quit claim the deed to me so she wouldn't do anything stupid. She wants to protect me and our children. We live in MD, how do I get that done? A few years ago, my wife refinanced the house and I am no longer responsible for the mortgage (although I do pay it) but I am on the deed. Thank you
Welcome vstancell,

You have mentioned that your name is on the property deed. In that case you are the partial owner of the property along with your wife. If your wife wants to transfer her share of the property to you, then she needs to sign a quit claim deed. Your wife can contact an attorney and get the deed drafted from him in order to transfer the property.
