quit clam deed?

does the quit clam deed have precedence over a will made at a later date over the same property?
once some one sings a quit claim deed and records it in the county, that would be final

how cna any one do a will on that property after they gave away that property

it is like sellign yoru house and again trying to give it as a gift to some one later

Hi gcurfman,

As far as I know, a quitclaim deed will get precedence over a will because it will become effective within the lifetime of the grantor. A will, on the other hand, would become effective after the death of the grantor. So, the quitclaim deed will get priority over the will.

yes. no doubt about it. quit claim deed is excuted before one's death. one at the time of death, will have no ownership in such case. so deed will not be considered as valid

gunz...sunny...you didn't read carefully...the poster is not looking for information on the use of a quit claim deed at all, but whether it would take precedence over a will if filed first.

as for the question, that's pretty obvious to me, as it was to most of our respondents.

After signing quit claim deed, one has no right on property. At a later stage if he is making a will, he is wasting time of others. has no right to do so ....
