can a quitclaim deed override a will?

Posted on: 18th May, 2009 09:50 pm
A new will was filed. A quitclaim deed was attached to the first will giving 50% to each each party. The new will now gives a bigger % to one of the parties and has also added a 3rd party to the new will. Will the new will override the quitclaim deed?
Hi drickey,

If there are two wills, then the last will is considered to override the first will. However, if the question is between a will and a quitclaim deed, then the quitclaim deed will remain effective over the will.
