Owner deceased but has a will

My mom passed away on July 23, 2008. She owned a condo that was paid for. Her will states that the condo should go to her children. Now we are told that the will means nothing and it will have to go to probate. Is this true?? Then what good is having a will?? She also signed a quitclaim deed that was signed, witnessed and notarized, but not filed. Is this of any good? We live in Florida and that is where her condo is.

Is there a question about the will being legal? one of the purposes of probate is to distributing the property of the deceased according to the will.

Is someone else laying claim to your mother's estate?

Contact the executor of the will and your mother's attorney who prepared the will and they should be able to explain it further.

I am not sure why the quit claim wasn't filed, but you can go down to the courthouse as well and see if it would still hold up. Call the recordation department in your mother's county.

The probate of the will is done in order to look after the fact that everyone mentioned in the will should get their portions in the property.

It is very important to file the quitclaim deed. Lawyers also suggest people to file it. You should immediately visit the county recorder's office and check it with them.
