if my wife and i divorce can she quit claim out of the house

we are both on the morgage we have can she get outa the deed and do i have to refinance because of it?we are in tennessee
Hi Jtravisdavis,

After divorce, your wife can quit claim her interest to get her name off the property title. But mere signing the deed will not take her name off the loan as it has nothing to do with the mortgage.
So, the lender should clearly be informed before such a transfer. And in that case, to transfer the loan in your name, it has to be refinanced in your name.

Yes ownership transfer might require the mortgage to be refinanced.
