quit deed

my fiance and i purchased a house the house is in my name first then his, we recently split and are living in different states. he agreed to take on the house, he is working on refinancing it to get me free and clear, would a quit deed get me free and clear from the mortage or just the house.

a quitclaim deed will only help you to get your name off the house. but you cannot take your name off the loan using this deed. for that, either you go for a refinance or do a novation.

i agree with adonis.

quit claim deed can be used only for house ownership transfer. it will not affect the mortgage. and even after you quit claim your interest in the house you will remain liable for the mortgage.

many people think that as the mortgage is on the house if the ownership is transferred then the mortgage will also get transferred along with it in new owner’s name. but it does not happen like that. the person who has taken the loan remains on the loan until it is refinanced by new owner.

It will be just the house.

Make sure you don't sign on anything until the mortgage is refinanced in his name or he shows you the approval letter from a lender. Otherwise what can happen is that if fiance stops making payments and house goes into foreclosure, your credit will be going down with his even when you are no longer on the title.
