Quitclaim question

I was wondering if my soon to be ex wife could simply sign a quitclaim deed, giving me the house (she does not want it)? Is there anything else that accompanies this? Additional documents etc, who do we give the quitclaim deed to and how do we proceed thereafter? Thanks, Joe
If there is a mortgage involving both of you then, no.

If no mortgage, yes.

You would record it at the county recorders office.

hello joseph,

your ex-wife may sign a quit claim to take off her name from the deed giving you complete ownership. the quit claim has to be notarized and recorded at the county office.

if she is on the mortgage too, then you have to refinance the loan in your name only or do a novation to remove her from the mortgage. and for that you have to talk to the lender first and take his consent.

Welcome to this forum.

Your ex-wife can sign the quitclaim deed to transfer the property to your name. You have to notarize the deed and then record it in your County Recorder office to make the deed valid.
