Can an Executor transfer property through a QCD w/o putting

a quit claim deed was issued to my husband's daughter's from me as executorix (sp?) to his two daughters. after a year this deed has not been filed. when asked why they said it was not right and had to be me in my name first? is the document legal" (drawn up by an attorney? if it is what is the hidden agenda why they want it in my name and then to them?

The quitclaim deed is perhaps considered illegal because they feel it should have your name as you are the executrix. Being an executrix, you have the right to administer and then transfer the estate of the actual owner of the property to the beneficiaries. Perhaps that is the reason as to why they want your name on the deed. But you can get it verified with another attorney.

Being the executrix, you are responsible for the property. Now, when you want the daughters to take over the entire liability towards the property according to their father's wish and want to release yourself from it, it is you who is transferring the property along with all other responsibilities through the quit claim. That's why, I think, the document should have your name on it.

Still you should consult an attorney for further assistance and ask him if you need to sign some other document for such transfer.
