Quit Claim/Divorce

my husband and i have been married for 39 years but separated for over 13 years. neither one of us at our age intended on getting married again so we both agreed not to get divorced. well now all of a sudden has filed for a divorce and i'm afraid its because he found out that i received a big amount of money from my dad putting me on a quit claim deed. the quitclaim deed had my maiden name first then last name. can he get his hands on my money? i'm in ky. if this helps. thanks.

I suppose your father has given the sum of money to you only through the quitclaim deed. If you husband's name is not there on the deed, then he will have no access to that money. His filing the divorce is not going to affect your money at all. And he will not be able to take any share of it without your concern.

No way Sylvia, I don't think your husband has the right over that money. The quitclaim deed is all about property transfers. Even if you do the quitclaim and receive money from your dad, your husband does not have the right to claim any share of it.

As per law, if any spouse receives anything as gift then other spouse cannot put a claim over it. And it remains his/her separate property.

So I don't think he can claim anything out of it.
