quit claim deed

my father, age 85, wants to sign a quit claim deed on his house over to my brother and myself. where do we get the form, must we have an attorney for this? how can we do it so the ownership will be transferred at his death and not before? my mother is deceased and her name is still on the deed. do we have to take another step to remove her name?
These situations can get very complicated. The act of signing over with a quit claim deed is easy. Where the complications come from is after his passing. He needs a will that specifically states what he wants done with his property. He could simply deed it to you now if he doesnt' have a mortgage.

I always recommend an attorney in situations like this. Especially if there are other people involved.

You should be able to find information at your local court house. But don't expect to get a lot of help.
