Name on Quit claim deed, But now Locked out of home.

Hello I need help. My life partner and I found a house together the loan Officer told me that I counld not be on the loan so therefore my name was Quit claim onto the Property. I left home oneday ofther having a misunderstanding with her. When I returned a week later she had changed the lockes and stated that I would have to take her to Court in order to get back in the house. The Memphis Police where called out to the home and stated that there was nothing they could do about it. I was told that they can not make her let me in the house I was told that I need to file a civil suite with the courts. I went to the court house and the cleark told me she has no ideal what kind of paper work I need to file. My ex Partner feels that because my name is not on the loan for the house that shes has all the rights and dont have to let me in, please help tell me what can I do what papers do I need to ask for at the court house. I have been homeless now for 3months. What r my rights.
Hi Erica,

Talk to your partner and make her understand that you have equal rights to the house as your name is legally there on the property.If she still does not listen, then file a case against her with the court.

i do feel sorry for you, after i read that you have been homeless for 3 months. but, if your name was quit claimed into the property, hence, you have your full rights to enter the house. you need to file a case against your ex-partner. for that you should consult a lawyer. you need to ensure that you have all the proofs like the quit claim deed, so on, for a strong case.

You are still owner of the house and your life partner is not allowing you to enter the house?

You need to make her understand that it is not important whether you have your name on the loan or not. You can have ownership rights over the house even if not on the loan.

Have you contacted any attorney and what did he say about it?
