reverse quitclaim deed

When my husband and I separated I quitclaimed the house to him. He did file the quitclaim with the register of deeds, but never pursued a title change. Also, he never refinanced so I am still on the mortgage. We have since reconciled (now 7 mos post quitclaim) and we're trying to get our accounts and property back in a shared state. What is the best way to "reverse" the quitclaim deed?

its good to hear that both of you were able to reconcile. :)

to reverse the quit claim deed what you need to do is to make a new deed and get it recorded. there no process by which a quit claim deed can be reversed. and if the previous owner is to get back his/her rights over the property then a new deed is to be made.

on the new deed your husband will be the grantor and you the grantee. previously when you quit claimed your ownership to him, on the deed you were the grantor and he was the grantee. this time it will be the opposite/reverse.

Clarification:
Can I draw up another quitclaim deed in this situation? Also, is there choice legal wording that should be used on the deed that states we equally own the interest in the property?

Hi Amanda,

Welcome Back.

You will have to draw a new deed for your name to be included on the title. As Miller said on the new deed your husband will be the named as the person quit claiming his rights and you as the receiver of the same.

On the deed you will have to mention how both of you will be holding the title. How the exact wording should be on the deed will be explained by your attorney who will be helping you in the deed recording process. In general I can tell you that on the deed it will be mentioned that your husband is quit claiming his half share in the property over in your name.
