Mother passed away with no will

Thank you to those who responded. If I decide to use a Quitclaim Deed, how would I go about completing it to add my brohter, sister and myself without transferring the title out of the remaining 2 Grantors's names? Thanks.

donna, i have read your previous post ( http://www.mortgagefit.com/propertytransfer/nowill-intestatesuccession.html ). as others have mentioned, your mother's share will get distributed as per laws of intestate succession.

the other two grantor's can make a quit claim deed to include all three of you to the title. in that case title will be shared by all, it will not result in transfer of title out of their names.

Grantors will make a quit claim deed in which they will transfer certain share they own over in your name. It will result in you, your brother & sister getting added to the title. It will not result in there names getting removed from the title.

Quit claim deed can be used for both purposes. It can be used to transfer all the rights to property and also to include someone to the title as co owner.

Hi Donna,

If you want to add yourself along with your brother and sister to the deed, it will not transfer the title out of the existing two grantors. After signing the quitclaim deed, you will be added to the property title along with them. Then you all will be sharing the title jointly.
