My boyfriend just heard from his x-wife. She wants to write off the interest that she paid for during the months of their short marriage. She filed a quick claim deed when they divorced. He refinanced prior to the divorce finalizing. Doesn\'t this mean she has walked away from this situation?
Yes but she still may be entitled to the portion that she paid while she was on the mortgage. She is not entitled to anything after the refinance. Hope this helps.

So she has no right on that property unless she has a life-estate on the property. But as Eric said can still get write off the interest that she has paid for during the months of their marriage.

I'm not sure if she can get a write off the interest on the previous payments even after the refinance. The documents that prove that she had been making the payments might help her.

You know with other tax deduction items, and again for the record I am not an attorney or tax professional, the deciding factor is time out of year. Like with child deductions, if parents are split up, whoever has them and is supporting them for the majority of the year gets the deduction. So maybe if you paid 8 months and she paid with you for 4 then you would get it. Just a guess and I don't even try to read the tax laws. I have enough mortgage laws to go through.
