County Clerk or Recorder

County Clerk or Recorder is a public official, usually at the county level, who keeps and maintains records of real estate in a specific geographic area. He is also known as a County Recorder.

For example, Kris is appointed by the government to look, manage and maintain the records of real estate, i.e. who owns it, the date of ownership, price of it, etc, of Diamond Street in San Francisco.

The 509.093 Standards passed by the 1996 Legislature are imposed on the documents to be recorded with the recorder:
  • The document shall consist of one or more individual sheets of size 8.5 inches by 14 inches.

  • The document can be printed, typewritten, or computer generated.

  • The document shall be on white paper of not less than 20 pound weight and have a clear border of approximately one-half inch on the top, bottom, and each side.

  • The top of the first page of the document shall contain a blank space measuring 3 inches. The right half of the page should be used by the county recorder for recording information.

  • The title should be prominently displayed on the first page below the blank space.

You can file a quitclaim deed yourself but it is always better to contact an attorney and take his opinion in this matter. He will guide you in a better way to fill out the deed as well as notarize and record it.

My X-husband, didn't file a quitclaim deed when we were divorced. If he goes to jail do I still have rights to the house ? Even if he's remarried? I allowed him to stay in the house , I left because of being scared for my life . My name is still on the property taxes also! Somewhat rights do I have to that home ?

First sentence first...Who owned the house to begin with? Was it joint between you and your then husband? Or did the home belong to him only? That answer will tell us how to answer your first question. If it was his home only, then you'd have no ownership interest at all. If you both owned it to begin with, then you'd still have an interest as long as you haven't transferred that interest to him or anyone else.

Did you quit claim your interest to him, assuming you had an interest to begin with? If you did, then you no longer have any rights to the home.

Why the tax collector continues to show your name as well as his is dependent, also, on your answers to the questions above.

i have been scamed into signing a quik claim deed from a man who found me in a foreclosure list he said he would stop the foreclosure and would take over the mortgage this was almost 7 months ago. three days ago my mortgage company called and said that they want to help me keep my home and do a streamlined modification now i can't because i was scammed into doing a quit claim deed. what can i do to keep my home. the clerk of court says this same guy has been in the office and filed several deeds he is out scamming so many people.

Hi bernard,

You can contact the other person and ask him/her to sign a quitclaim deed and transfer the property to you solely. This will make you the sole owner of the property.

can I add my adult kids to house deed so when I pass house wont go to probate

You can use a quitclaim deed in order to add your adult kids to the property deed. You can contact a real estate attorney and he will help you in this regard.
