when a mortgage broker proves to be incompetent and fails to comply on what he initially promised on a refinance, and in the end is unable to provide a refinance that actually saves money, shouldn't the broker be required to return fees charged, such as appraisal fees?
Yes, if you can prove incompetence. You're saying she promised on your refinance ... was that a verbal promise, or did you get it in writing?
