Co-Borrowers Judgment

i recently discovered (while trying to refinance into co-borrowers name so that i could buy a diff house) that there are judgments in his name against the house. :evil:

would these judgments (rather large, child support) affect my credit at all since the mortgage is joint?

and from everything i've researched, it appears i'm @#$@#$&@ until he satisfies the judgments?! :x
the only way your credit can be damaged is if they stopped paying on the mortgage.
the judgment is attached to the home... not the loan

Welcome to forums!

If your name is not involved in the judgment, then it won't affect your credit. However, it is true that unless the judgments are paid off, you and the co-borrower won't be able to get a loan together.

Is there enough equity in the house for the coborrower to take cash out while refinancing to satisfy the open judgments?

FHA mortgage does cash out up to 85% of the house value. Of course, coborrower needs enough income and a good enough credit score to do any kind of refinance.

Unfortunately, there isn't enough equity with the housing market the way it is.

I understand this individuals judgment but since I am in no way related to the co-borrower, it angers me that this outside person (unknown to me) is able to tie up my asset as well.... I should have some recourse, but it appears I don't.

Next step is the co-borrow retaining attorney regarding judgment. If it isn't resolved, I will seek the court to partition the home and force a sale. The friendship will obviously end there but I see no other way out.

Unfortunately, nothing much can due as the victim.

You have stated pretty much what needs to be done. Not pleasant, but, it is a plan.
