Community Property vs Separate Property

Posted on: 19th Jan, 2010 12:13 am
owning prpoerty prior to marriage and then placing spouse on title upon refinance. what happens at that point to the community vs separate property interest.
Hi Unicorn,

If you own a property prior to marriage, then it won't be considered as your community property. However, if you refinance the mortgage and add your spouse to the property and the mortgage, then he/she will have rights to the property. Moreover, if the mortgage is being paid from the community funds, then it will be considered as a community property.

Thanks
