i signed a quickclaim deed a 1.5 yrs ago when i was going through my divorce. my lawyer didn't really explain to me what this was. my ex has since remarried and lives in the condo that we shared. i want to get my name off the mortgage but the bank will not give me any information about this along with my ex. once i signed this deed i lost all rights to know anything. can a lawyer get me out of this mortgage before it's too late? or if not what are the steps? i know she has to refinance the condo under her new name, but is there anything else i can do???
what i fail to understand is why the lender wouldn't speak with you if you're still a party to the underlying loan. you mention that and added, "along with my ex." what's that phrase mean? will they not release information to her either? the signing of the quit claim deed should not have diminished your rights to knowledge of the status of the loan, unless she did, in fact, refinance.

Well the bank will not tell me if she refinanced or anything. If I knew I lost all my rights to know anything about the loan I would have never had signed the deed. My ex has refused to tell me anything about the load or if she is being refinanced, or working out about it. I did find out about the load and how much is left on it. But as far as finding out if she is trying to refinance they won't tel me since I signed this deed.
Would you think there would be a way to take her to court and have my name removed from the load completely? Of is it just as simple as her getting refinanced and that's it....

It is as simple as the refinance that she may or may not be obtaining. I understand now what the lender isn't telling you, and that's legitimate. And she has no obligation to tell you, either, frankly. That doesn't do much good for you, of course, but at least you know where you stand.
