no enough equity

ok here is my sad story i am almost done with my divorce and my husband will give me his part of the house so we did the quick deed form but he is on the loan also as primary and i am secondary and i cant refinance since i dont have enough equity even that i been paying for 4 years i read the only 2 options is refinancing or selling since he is the primary he can sell the house to me since i am the co-borrower?

Unless you refinance the mortgage in your name, you won't be able to remove your ex's name from the property deed. If your ex sells off the property to you, then the mortgage dues should be paid off in full after the property sale.

according with my lawyer with the quit claim I can remove him from the property deed but what I want to remove him from the loan

Hi Guest,

If you want to remove a person from the loan, then you'll have to refinance it. Once you refinance the mortgage in your name, then you'll be solely responsible for the loan.
