my ex and i divorced 4 and 1/2 yrs ago. at the time he would not pay half closing or half assumption costs for refinance and i could not afford full costs. he decided to buy a house and signed a quit claim deed in order to obtain financing. he is now dating one of my family members and is trying to force a refinance so he buy a house with her. he threatened to sue me. i am not opposed to refinancing but several circumstances have ruined my ability to do so at this time. i was off of work due to the death of my twins. my divorce settlement says to execute releases in a reasonable time when requested. his time is immediate and he still will not help pay for costs. it also has. confidentiality cause that he is in contempt of by sharing info regarding our settlement with my cousin because he is trying to buy a home with her and has shared info regarding our settlement in doing so. it states only with an attorney or accountant. can he force me to sell if i am unable to refinance? will i lose my home? and if i am forced to sell what happens if it doesnt sell? i am on the deed. both of us on mortgage. i just need time to rebuild my credit.
He may force you to sell off the property but if your name is on the property deed, then it will also be your discretion as to when you will sell the property. You can try assuming the loan in your name. You can even take legal actions against your ex-husband as he had shared confidential details with someone else.
Is your name on the papers? If yes, then needn't worry as it's up to you whether or not you'll sell. Consult an attorney if things get out of hand.
