hello...
my ex-husband and i divorced 5 years ago...the mortgage to our home is in his name, but both our names are n the deed. our divorce papers state that he resigns all interest in the house and tha i will make the payments. there was no quit claim deed and no stipulation that i refinance and i have made the payments as stated. another side effect of our divorce is that my credit was ruined...he left with over half the income, but none of the bills since everything bu the mortgagge was in my name and with 3 kids i had to make choices to keep a roof over our heads....i've maintianed good payment history for three plus years, but have seeral collections. at this point i have remarried and would like to know:
1) is it possible to sell my house to my current husband..i am pretyy sure the answer is no, but jsut checking or
2) how can i get the house refinanced in my current husbands name...there is a good bit of equity in the home and our homw is to get cash out and pay off all the collections in y name an start to rebuild my credit.

Depending on your state, the language in your divorce decree may be sufficient. I would advise you take a copy of your divorce decree in and talk to an attorney at a title insurance company to see if they would be willing to write a new title policy on it. If not, that person should be able to advise you on what steps to take next.
