My partner on the morgage is my son. I was 65 at the time. He put me on the mortgage in name only for a couple of reasons; not pertinent to this topic.
Now, since I've received State Assistance for the past seven years, the State has put a lien on my son's property, wanting monies returned to the State for what
he gained last year in a refinancing opportunity.
When he refinanced, he did so alone. Leaving me out of the contracts and off of any home owner, mortgage documents. But, the County records still has me listed and says, I must transfer my shared interest, BUT also pay the State back.
If this sounds confusing, I'm sorry, but I too, am very confused and now stressed because, we don't have any monies for the State and my poor son is now stuck with a lien on his first home.

As your son has refinanced the mortgage in his name, you can definitely sign a quit claim deed and remove your name from the property deed. However, this will not remove the lien from the property. If the lien has been placed on the property, you or your son needs to pay it off and get a lien release certificate. If you cannot pay off the lien in full right now, you can ask the State for a payment plan. This may help you in paying off the lien.
