can my lawyer to file a refinance with the court while i am in a chapter 13 bankruptcy

If you have filed Chapter 13 bankruptcy, then you won't be able to go for a refinance now. You will have to wait till your bankruptcy filing is discharged.

While in Chapter 13, you can refinance as long asa copule of conditions are met:
1. You must have been in repayment 12 months or longer
2. There may not have been any late payments. You must have made all payments as agreed.
3. The trustee of the Chapter 13 payments, the lawyer, has to agree that it is ok for you to refinance.
