we want to refinance our home, which is only in my name. i however filed banruptcy last year due to a second property. can my husband refinance the home without me on it?

was the property included in the bankruptcy filing? it will depend upon the type of bankruptcy you filed for. if you filed chapter 13 bankruptcy and are paying off the loan according to the payment plan, then you may try for a refinance. but it would be the lender's discretion whether or not he would accept your request. your husband will not be able to refinance the loan in his name if his name is not on the property deed.

The property was included in a chapter 7 bankrupcy. How do I find out if hes on the deed?

If your husband doesn't have an ownership interest in the home he's not going to be able to refinance by himself. Call your county assessor and ask who owns the property, or go the county recorder's office and get a copy of your deed to see if you both own the property or if it's just you. Depending on where you live this info may be available online.
