As the loan is in your name, you would be able to refinance the mortgage without his signatures. However, I would suggest you to ask your ex-husband to sign a quit claim deed in your favor and transfer the property to you. This will make you the sole owner of the property. Thus, your ex-husband will not be able to claim any share from that property.

yessssssss you can !! as you say you are only on the loan .... then no need for sign form him on a paper .... you have a rights on the property.... so you can good luck :)

there is a need for you ex-husband's signature if you attempt to refinance. inasmuch as he remains an owner of the home, the lender is going to insist that he sign all the mortgage documents. the only way to avoid that is, as sara succinctly said, is for him to execute a quit claim deed transferring his ownership to you, ttapaya.
