hello,
i am in a joint mortgage with a friend. i moved out of the home a while ago but never took myself off the loan. my friend who is also on the mortgage lost her job and couldn't pay for the home for many months until she got rehired at a new job. now my credit is bad and i'm trying to have her refinance and take me off the loan but she doesn't qualify for a loan on her own. what can i do if she can't refinance? i need to get off this mortgage in order to rebuild my credit. is there a way to legally take myself off of the mortgage?

The only way I know of is for your friend to refinance. That's the only legal way to get you off the Note.

it makes sense to me that you and your friend ought to sit down and figure out a solution. it's not just your credit that's in jeopardy, but hers as well. perhaps you can come up with an amicable solution that will alleviate all the pain and get you back to where you'd like to be with credit. once the loan is back on track and credit is repaired, she'd be able to refinance, perhaps, and eliminate your obligation on that loan. in the meantime, despite what you and she may have worked out, you are still liable for payments on that mortgage.
