my mother got a house and decided to refinance. at the time her credit was not great. the house was put in my mother in laws name. now some years later, my mother in law wants to move and be removed from her name on the mortage and for it to go back to my mother's name. i know that a lot of people say to refinance is the only solution, is this true? i don't want to sell the house, take money out, just make it possible for my mother in law to be able to get an apartment, without her being held accountable for a loan of house of which she has nothing else to do with...thank you

In order to remove your mother in law's name from the mortgage doc, your mother will have to refinance the loan in her name. Your mother can speak to the lender about novation which is also one of the ways to transfer mortgage. However, in most cases, the lender would prefer a refinance.
