i am having problems closing on a refinance because the loan broker can't get the correct information from the irs. the problem is that someone used my social security number to fraudulently apply for a tax refund in 2011. now when the bank sends in the 4506 t they get the fraudulently filed return showing me filing single, not as married as was on the actual return that my wife and i sent in for 2011. the irs says that the mortgage broker will never get the joint return that they want because the first return that was filed is the one that comes back with the 4506t. the bank says they cannot finish the loan without proof that we filed a joint return. how can i solve this?

I recently had a problem just like this. The borrower had to call the IRS advocacy line at the IRS and explain the issue. The IRS then sent the borrower the proper forms to basically state the claim that there was fraud involved in the filing of the tax return. We were able to use this, along with the stamped tax return from the borrower, stamped by IRS
