Name not on Deed but on Mortgage

Posted on: 18th Mar, 2010 10:08 am
I am married and have been for many years. My husband is older and It was originally his home. We have refinanced several times and my name was put on the mortgage and at the time we paid the broker to have my name put on the deed but it did not happen. What are my options now, If my husband passes, I am responsible for paying for a home that I don't own.

Hi Debi!

Welcome to forums!

You can ask your husband to sign a quit claim deed and add your name to the property deed. Once he signs the deed, you'll have to notarize it and record it at the county recorder's office. After the whole process is complete, you would become the co-owner of the property. Thus, your name will be mentioned both in the property deed as well as the mortgage.

Feel free to ask if you've further queries.
