Hi all, thank you for your responses.
I had recently posted this two months ago My mom passed away 2 years ago in January and the will has yet to be probated because we can not find it. The mortage is being paid by myself and I am currently living in the house and how can I approach the mortage company with my interest in purchasing the house for myself? Also, the homeowners insurance policy will be ending soon and I can not renew it. How can I accquire home insurance in a timely manner? My current policy will not renew as the original owner no longer is living in the house. I am currently living here as I am caring for younger siblings (our father died as well) one of which is 10 years old. I am 28 yrs old with a succesful career and my finance is 38 and we are willing to purchase this house. I have tried to talk with mortage company but they will not speak to me as I am not my mom, the original owner. ANY HELP would be appreciated!

I have hit quite a snag.
My mother did not leave a will and I will have to present to the court a hollographic will. In the mean time while I await a court date, the house has been placed with a property tax lien. Is there anything I can do to stop the house that I am living in being foreclosed on? (seems like I may be one of the statistics on the news) but I really want to refiance this house myself to stop all of this madness as we are currently living in it!

Just pay off the property tax lien asap to clear the property. As for the insurance premiums, there are a lot of reasons for which the insurance policy renewal may be canceled. For instance, your mom may have filed more claims than any average person. May be the property no longer meets the underwriting standards followed by the homeowners insurance company.

What i feel is, since there is a Will, get it probated first. So, you'll come to know who's the owner of that house. Then possibly the new owner will be able to renew the policy. Read through the terms and conditions in the insurance papers. I think it will be stated there as to upon what conditions a renewal is possible.

i suspect you might do well to consult with an attorney - have you done so? your post does not make mention of any such contact.

i also suspect that the outcome will be in your favor, as long as you get good counsel moving forward.
