how to put name back?

Posted on: 30th Sep, 2009 09:59 am
Hi, 9months ago, we refinace the house, the loan officer told my husband to allpy loan on his name only ( his credit rating was better than at that time), so they drop my name out of the house title deed. Then I received a letter from the Los Angeles Record sayiing I am no longer on the property title. Now we are trying to put back my name back to the house title deed. Do I have to use lawyer or just go to the Los Angeles Record to file my own to put my name back? Any legal issue to consider? I call the cout house information regarding this issue, but impossible to reach person.
right now your husband is the only owner of house. he needs to sign a quit claim deed as a grantor. your & his name will be mentioned as a grantee.

Hi singtoheaven,

It is not mandatory to use a lawyer to add your name to the property deed. You can ask your husband to do it himself. Sample quitclaim deed forms are available online and he can get hold of these forms to add your name to the property.

However, to be on the safer side it is always better to take the help of an attorney and get the deed drafted from him. Also, you should remember to inform the lender about this change in the property title before the deed is signed. In case, if the lender has any issues he would let you know immediately. Once the deed is signed, make sure to notarize and record it.
