I will be filing for divorce and I am 5 years into a joint mortgage in his name first, mine second. Propoerty was about $110,000, A qquestion that I have is could he refinance it?? If I can do a quitclaim deed before I file for divorce, please advise me. He does not want to move again and I think will be accept handing it over to him. Foreclosure is a last resort, but I want out, and don NOT ask for anything in return. My work, day[color=Red:7491105d66] removed numbers[/color:7491105d66]

So, you wish to move out and hand over the property to your spouse? ok, a quitclaim will help in transferring the property to him. But you can execute the quitclaim simultaneously with the refinance. Check out the faqs on refinance prior to going for it.

do the quit claim in title on the condition that he refi.
