hi, my husb and i are getting a divorce asap as he cheated on me/is leaving me. we just bought our home in sept. he said he'll keep home, get a pt job (in addition to his ft) so he takes on burden but i dont trust he'll make payments and it will haunt me down the rd even to possible foreclosure. we're barely making ends meet so there is no way either of us can pay mortgage soley and / or get another place while helping make mort payments. he does not qualify for refinance and i cant afford an attorney here in florida. im desperate and have no idea what i can do to get off mortgage with countrywide so i dont suffer any more than i have already... or if there is a way to lower my payments by 900 so he doesnt keep house since my parents paid downpayment as gift....im lost!!!!!!! :-( if someone can help with advice if there is any way out... please please help me... thank you in advance - d

In order to get your name removed from the mortgage note, your husband will have to refinance the property once you quitclaim the property to him. Once he does so, your name will be removed from the mortgage note. As far as lowering the payments is concerned, it will be totally the lenders discretion.
