my wife and i built a house a few years ago. when i obtained financing for it, i found out my wife had several thousand dollars worth of credit card debt she had taken out in my name, which, needless to say, created major marital strife. when i closed on the loan, i paid off the debt she had created. last year, she convinced me to add her to the title of the property via quit claim deed. afterward, she moved into her own place. i currently have an adjustable rate mortgage and must refinance in order to make payments but she refuses to sign the paperwork to let me. i informed her that the home would go into foreclosure if i could not refinance and she told me that would be fine with her. she is planning to have her father purchase the house in a short sale. she is not on the mortgage. how can i protect myself and my credit? divorce is eminent.
You had better get a divorce court involved quick. You handed over half ownership and continued to have all of the obligation.
It will take a court order to force her to sign it over.
Good Luck

You can remove her by doing another quit claim. I agree with Brian, time for an attorney to get involved.
talk to a lawyer quick
