Ex has still not refinanced the house..one year later

my situations is this. my divorce papers state that my ex husband would refinance the home and pay me 20,000 and we would obtain a quit claim deed to remove my name from the mortgage. it has been nearly one year already. he has paid me the money out of his retirement account but has yet to refinance the house. i have been patient with him due to his financial situation, however, he now has his job back, is remarried, and has yet to go to the bank to apply for the refinancing loan. iam at wits end as to what i should and can do legally. i really just want my name off of the mortgage. iam planning to buy a hom ein the next year but this is showing on my credit. any advice is greatly appreciated!
Contact an attorney for this. If the divorce docs state the home must be refinanced in order to take your name from the mortgage loan within a certain period of time, I would say you may need to go back to court to fight for this. I hope this helps...

i concur. assuming you had a lawyer involved in your original divorce case, i'd think that's who ought to be able to assist you. you may very well end up in front of a judge who can direct your former spouse to take the action of refinancing.

Have you spoken to him and aksed him whats his plan for refinance?

Looking at your post you were waiting for him to refinace and due to his fincial situation you were not pushign him.

Lot of times thigns can eb sorted out just by communicating. I would suggest that before brining the attorney first.

You always have the option to go to court when he says he is nto willing to refinance and take your name out of the loan.

What can I say George, some times we forget simeple solutions. Its always better to ask than to assume.
