Can spouse be removed from loan through interspousal deed?

Posted on: 11th Oct, 2008 09:06 am
in nebraksa, if my spouse signs a interspousal transfer deed in our divorce, am i still required to refinance my mortgage, or will i be able to simply have his name removed from the loan documents by showing the bank the interspousal transfer deed?
Hi klumrm!

Welcome to forums!

You cannot simply remove his name from the loan documents. The lender will ask you to refinance the loan.

Feel free to ask if you have further queries.

hi klumrm!

to remove your ex-spouse's name from the loan documents, you will have to refinance the mortgage. you can go for the process of novation. but lenders generally prefer refinancing.

thanks,

The current lender may be able to remove his name......you would have to be able to qualify on your own for the mortgage. You should call them and ask. If not then you will need to do a refi.
