my boyfriend has been divorced from his ex wife for over a year now. she was living in the house up until november of 2008. they did not have attorneys when they divorced, so there is nothing mentioned on who got the house. she continued to make the payments because there is a first and second mortgage on the house. the first mortgage is in his name alone and the second one is in both names. he got an attorney early last year, because she was supposed to be refinancing but he kept getting the run around from her. he was being told it was going to close in august then september then he was told he was going to have to wait until january of 2009 because they needed another 1099 from his ex wife. after going to court she stated she did not want the house and moved out at the end of november. at the time he did not want the house and the judge said to put house up for sale, but he decided he wanted to keep it. she agreed to sign off but now leaves him a message saying she is closing this month because her name is still on the house and that is her right. he has already moved back into the house. how can she be getting information on a mortgage that is not in her name and trying to refinance it? is this possible? she moved out and said she did not want the house and he has already remodeled the inside and is almost finished. does she have the right to come back for the house after she moved out and destroyed the inside and took everything including light bulbs, ceiling fans, flag pole, mailbox, window from garage and hutch that was attached to the dining room. pleas help!
This really sounds like a question for an attorney.
