going through an ugly divorce in sc but own a home in md; nothing is final. it was agreed at mediation to sell property but ex is refusing. now he is attempting to refinance the property so he can keep it; however, i have not agreed to let him buy out my interest.
can he refinance and/or qualify for a loan to buy me out if both our names are on mortgage? can he do anything at this point with the property until i agree to let him buy me out?

Hi angel,
Your spouse may be able to refinance the loan in his name but unless you sign a quit claim deed in his favor, your name would remain on the property deed. This will let you remain as the owner of the property and he won't be able to sell property or force you to leave it.
