Taking a name off of a deed and Mortgage

i am looking to refinance my mortgage which ahs both my name and my soon to be ex husbands name on the loan his name is also on the deed. how do i remove him from both if we are not divorced? is there something that he can sign to be removed from both?

You'll have to ask your would be ex-husband to sign a quit claim deed and transfer the property to you. This will remove his name from the property deed. Once he does so, you can refinance the mortgage in your name. Thus, you would become the owner of the property and will also be responsible for the mortgage dues.

a quit claim deed is a legal form - you can do an internet search and find blank ones for sale, i'm sure - search by state, as each is different, i believe. you can have an attorney draw up the deed and any agreement that you plan to have concerning this, and of course you'll pay for that. you can visit an office supply store (call first) and they will probably be able to supply one.

he would be the grantor and you the grantee (he grants to you). the deed would need to be witnessed and notarized; following that, you would record it with your local town, county, etc. in the land records.
