Hi xmax,
You will have to ask your father-in-law to sign a quit claim deed and transfer the property to you. Once he does so, you need to refinance the mortgage to transfer it in your name. This will make you the owner of the property and the mortgage. However, you need to have equity in the property if you want to refinance the current loan.
Thanks,
Jerry
