our primary residence is in trust. we like to refinance. i do not have a good credit, but my husband has. also i do have a judgment of about $5,000 on my name. because of his good credit and income, i would like to quit claim for him to refinance with ease. my question is, in the attempt of removing from the trust and me quit claiming, is the judgment will interfere with him trying to refinance.
HI Guest,
I hope your creditors have not placed a lien on your property. In such a situation, you may quit claim the property to your husband who can refinance the mortgage in his name. However, I would suggest you to contact a real estate attorney and take his opinion in this matter.
Thanks
