my house is on my wife name we were trying to refinance to add my name to the title and get some cash-out. but, the underwriter countered and said per texas cash out laws since i’m not currently on title, the loan is not eligible for cash out. what should i do?

I'm not sure about the law in Texas as mentioned by the underwriter. However, you can ask your wife to add your name to the property deed by signing a quitclaim deed and you and your wife can then refinance the mortgage after few months in order to get a cash out.
