if i die and do not leave a will, can my son refinance the home and put it in his name?
Hi Dodie,
Welcome to Mortgage fit,
Yes,He can...If he hhave more siblings then they have equal right on the property and thus your son need to ask them to sign quitclaim deed in order to refinance the mortgage....
In order to accomplish this ...he need file an application with the county office for transferring the property to his name under heirship.
So ,in nutshell it is possible even without a will.
Feel free to ask any further query if you have....

Hi dodie!
Welcome to forums!
Your son will have to file an affidavit of heirship at the county recorder's office and get the property transferred in his name. Then he can refinance the mortgage in order to transfer it in his name and pay off the mortgage.
Feel free to ask if you've further queries.
