my second lender has bypassed foreclosure and has filed for summary judgement on the note alone, ignoring the secured (and filed) second mortgage (i live in florida). why are they able to do this?

Well, an attorney will be able to tell you as to why your first mortgage lender was able to receive a summary judgment. Such judgments are mainly issued when there is no dispute in regards to the facts of the case. However, as far as I know, you would be responsible for paying off the second mortgage dues. I don't think that the lender would forgive the mortgage.
