i am in the process of a divorce, my soon to be ex told me i can have the house, which still has a mortgage and there is a second mortgage attached to the home. how do i get the home with original mortgage and the second mortgag split?

your soon to be ex can sign a quit claim deed and transfer the property to you. this will make you the owner of the property. as far as the mortgage is concerned, you need to refinance both the loans. while you refinance, you can request your husband to pay a portion of the mortgage dues.
