I have been awarded the matrimonial home of thirteen years (transfer of deeds) the mortgage is solely in my husband name. Without my knowledge or consent he got a secured loan against our family home. I am the sole carer of our four children and just recently became a full time student. I can just manage to pay the mortgage but with the additional payment of the secured loan I am struggling.... Is it possible to have the secured loan removed and my exhusband made responsible for the loan he does not pay child support or any type of maintance.... The children and I would would be alright without this additional payment for the loan. The exhusband has another investment property one here in London another abroad.... Help :(
dellgirl, i don't know how much assistance you'll get on here. most everyone here is located in the US, and though i've seen a few posts from people in the UK, they are few and far between. and, of course, even with commentary from those us across the ocean, you'll only get references to the laws we are aware of here.
i don't know if there are other communities such as this one that are better represented in the UK and elsewhere, but if so, they'd be much more helpful to you, i believe.

Hi dellgirl,
The laws do vary from one country to another and I'm not sure if the suggestion that works here will be effective in your country. However, it seems impossible to remove the secured loan until it is paid off in full. If the loan is not repaid the lender can foreclose your house to satisfy the secured lien. As far as the mortgage responsibility is concerned, I believe your husband is the one who is liable to repay it. You should not be held responsible for it as you did not sign on any loan papers.
